Obama Regime Continues To Shred US Constitution

If the US Constitution was still in effect, was still an operational document, was still the law of the land, then the Transportation Security Administration would be in very deep trouble today. However, as we have all come to know all too well, the constitution is all but totally ignored today, especially under the administration of the Obama Regime.

When Obama was sworn in, the constitution was considered, found to be inconvenient for his socialist agenda, and ignored.

The latest blatant violation of the US Constitution was the much-publicized “detainment” of Senator Rand Paul of Kentucky — while he was enroute to Washington, DC to exercise his duties in the US Senate. That “detainment” was totally unconstitutional … period.

You see, Senators and Representatives cannot be arrested for a crime, except for treason, felony, or breach of peace, while meeting in Congress or while traveling to or from a meeting of Congress.

If Senator Paul was detained, then he was arrested. Consider this: “(v) Arrest is the action by which a person is stopped from his normal activities by virtue of a legal authority or sanction, either by detaining him or by stopping his external accesses.” (SOURCE)

Don’t believe me?

Read it for yourself:

Article 1, Section 6 … US Constitution:

1: The Senators and Representatives shall receive a Compensation for their Services, to be ascertained by Law, and paid out of the Treasury of the United States.6 They shall in all Cases, except Treason, Felony and Breach of the Peace, be privileged from Arrest during their Attendance at the Session of their respective Houses, and in going to and returning from the same; and for any Speech or Debate in either House, they shall not be questioned in any other Place.

Now, THAT’S the wording from the text of the US Constitution … the law of the land.

I do not particularly agree with that portion of the US law, but it DOESN’T MATTER. It is THE LAW! Until such time as there is an amendment to the constitution affecting Article one, Section six to change or remove those few words, it remains the law of the United States.

There has been much bloviating in the press and in the blogosphere since the incident happened. So I don’t expect my opinion to make much difference, at all.

However, on the outside chance that you might care, allow me, please, to point out, once again, that our government, as it is currently constituted, is NOT following the law of the land. We have, in my opinion, a rogue government in place in Washington, DC.

The Transportation Security Administration is just another government agency out of control. It is a power hungry bully; full of itself, and — in the real world — it does more to restrict freedom of movement in this country than it does to ensure it.

On the TSA’s website they say: “We are 50,000 security officers, inspectors, directors, air marshals and managers who protect the nation’s transportation systems so you and your family can travel safely.” (SOURCE) I dare say the “volk” of the Gestapo, in 1930’s Germany, thought of themselves in much the same manner.

I have been offering commentaries for decades and there has been a common thread running through the millions of words of opinion I have shared. It is this: We Americans are voluntarily giving up our freedom.

Have you noticed how we whine and complain when the Congress is tied up in knots and unable to legislate? We seem to have forgotten that to legislate is to pass laws.

Every time a law is passed some of us lose a little bit more of our freedom. Eventually, ALL of us lose small portions of our freedom, until one day, we finally stop and take stock of our current liberties — and we find we are in deficit. Our freedom is gone and we are in hock to the government.

It seems to me that pretty much sums up our current situation.

Freedom, once lost, is almost impossible to reclaim. Much like an ocean liner, it takes a very long time to stop a government with the momentum of the US government.

Back in 2010 we sent a new batch of conservatives Senators and Congresspersons to Congress with a clear mission to bring the Congress to a halt and keep it static until the Obama Regime could be ended in November — and we could gain control of enough of the national legislature to begin the process of returning sanity to our government.

Both the left and right wings of the American political spectrum have reviled them. Even so, they have done a fair job at slowing the Congress down.

Somehow, Americans have lost their love of the freedom and liberty for which our forefathers gave their lives and fortunes.

Now, if you think I am being overly dramatic here, I ask you to look again at what a government agency did to a US Senator and ask yourself, if they can do that to one of the most powerful men in the country, WHAT can they do to me?

This is one of the most important columns I’ll ever write and I’ve written several thousand over the years.

While millions were guzzling the booze, the usurper, Barry Soetoro aka Barack Obama, decided to sign the National Defense Authorization Act on New Year’s eve while playing in Hawaii on borrowed taxpayer dollars.

As millions who are informed about the internal destruction of this country read the language of S. 1867 and the house version, H.R. 1540, controversy arose over several sections (1021, 1022 and in the senate bill 1032); in particular the word requirement.

SEC. 1032. REQUIREMENT FOR MILITARY CUSTODY continues over to page 362:

(b) APPLICABILITY TO UNITED STATES CITIZENS AND LAWFUL RESIDENT ALIENS.

(1) UNITED STATES CITIZENS. The requirement to detain a person in military custody under this section does not extend to citizens of the United States.

The putative president with no power to sign anything into law has now clarified it for everyone. This is from one media source (emphasis mine)

“The new law now requires military custody for any suspect who is a member of al-Qaida or “associated forces” and involved in planning or attempting to carry out an attack on the United States or its coalition partners. The president or a designated subordinate may waive the military custody requirement by certifying to Congress that such a move is in the interest of national security.

“The administration also pushed Congress to change a provision that would have denied U.S. citizens suspected of terrorism the right to trial and could have subjected them to indefinite detention. Lawmakers eventually dropped the military custody requirement for U.S. citizens or lawful U.S. residents.”

“My administration will not authorize the indefinite military detention without trial of American citizens,” Obama said in the signing statement. “Indeed, I believe that doing so would break with our most important traditions and values as a nation.

“Here is the text of Obama/Soetoro’s official statement from the White House

“My Administration strongly supported the inclusion of these limitations in order to make clear beyond doubt that the legislation does nothing more than confirm authorities that the Federal courts have recognized as lawful under the 2001 AUMF. Moreover, I want to clarify that my Administration will not authorize the indefinite military detention without trial of American citizens.”

Our most important traditions? The Bill of Rights is now a tradition? But, of course, Obama/Soetoro is a pathological liar and there is that pesky sentence above containing the words “may waive the military custody requirement”. A signing statement has no weight of law so I can assume that somewhere down the line, the opposite of what the usurper says will happen.

So, now what are you going to do about it? After the “Patriot” Act was signed, the Internet was flooded with a thousand columns. Hand wringing, moaning and lots of martial law is coming!!!!

What did people do after the John Warner Defense Authorization Act was passed in 2007?

Use of the Armed Forces in major public emergencies

“(B) suppress, in a State, any insurrection, domestic violence, unlawful combination, or conspiracy if such insurrection, violation, combination, or conspiracy results in a condition described in paragraph (2).

“Lots of hand wringing, moaning and big macho talk followed that new law which accomplished nothing.

But what about Posse Comitatus people screamed in columns and on talk radio? Well, it was being chipped away while everyone ignored the solution:

Battle Plan for the 50 States (Sept. 2008)

“The Posse Comitatus Act, a United States federal law (18 U.S.C. § 1385) passed on June 16, 1878, prohibiting most members of the federal uniformed services (the Army, Air Force, and State National Guard forces when such are called into federal service) from exercising nominally state law enforcement police or peace officer powers that maintain “law and order” on non-federal property (states, their counties and municipal divisions). In other words, the PCA limited to a great degree the powers of the federal government to use active military for law enforcement.

“There have been more laws enacted by Congress over the years explicitly allowing the military to be used in certain domestic scenarios. Legal hawks say the most significant is the ‘Military Support for Civilian Law Enforcement Agencies Act of 1981 (“MSCLEA”), the purpose of which is to allow the exchange of information and services between military and law enforcement “when necessary” to protect the people and interests of the United States.

“Major Craig T. Trebilcock, U.S. Army Reserve, penned a paper titled, ‘The Myth of Posse Comitatus’, in October 2000, where he said: “Is the Posse Comitatus Act totally without meaning today? No, it remains a deterrent to prevent the unauthorized deployment of troops at the local level in response to what is purely a civilian law enforcement matter.”"Really? Did you forget New Orleans and WACO, Major Trebilcock? His paper was a justification for use of military within the states of the Union for “domestic terrorism.”

Anyone who has taken the time to learn the history of how this constitutional republic was birthed know without any doubt the states at that time did not hand over all the power to the General Government. Far from it and the limitations on the power of the newly created General Government, the body for lawmaking being the U.S. Congress are succinctly spelled out in Art. 1, Sect. 8 of the U.S. Constitution. Let me quote Joseph Story, Associate Justice, U.S. Supreme Court, Commentaries on the Constitution, 1833 – emphasis is mine:

“Another not unimportant consideration is that the powers of the general government will be, and indeed must be, principally employed upon external objects, such as war, peace, negotiations with foreign powers and foreign commerce. In its internal operations it can touch but few objects, except to introduce regulations beneficial to the commerce, intercourse and other relations, between the states, and to lay taxes for the common good. The powers of the states, on the other hand, extend to all objects, which, in the ordinary course of affairs, concern the lives, and liberties, and property of the people, and the internal order, improvement and prosperity of the state.”

One of the biggest mistake the states have made over the decades is to accept money from “laws” passed by Congress making the borrower slave to the lender. I put laws in quotation marks for a reason:

16 Am Jur 2d, Sec 177 late 2d, Sec 256:

“The general misconception is that any statute passed by legislators bearing the appearance of law constitutes the law of the land. The U.S. Constitution is the supreme law of the land, and any statute, to be valid, must be In agreement. It is impossible for both the Constitution and a law violating it to be valid; one must prevail. This is succinctly stated as follows:”The General rule is that an unconstitutional statute, though having the form and name of law is in reality no law, but is wholly void, and ineffective for any purpose; since unconstitutionality dates from the time of it’s enactment and not merely from the date of the decision so branding it. An unconstitutional law, in legal contemplation, is as inoperative as if it had never been passed. Such a statute leaves the question that it purports to settle just as it would be had the statute not been enacted.

“Since an unconstitutional law is void, the general principles follow that it imposes no duties, confers no rights, creates no office, bestows no power or authority on anyone, affords no protection, and justifies no acts performed under it…..”

A void act cannot be legally consistent with a valid one. An unconstitutional law cannot operate to supersede any existing valid law. Indeed, insofar as a statute runs counter to the fundamental law of the lend, it is superseded thereby.

“No one Is bound to obey an unconstitutional law and no courts are bound to enforce it.

“The problem we face is there is no longer any true justice in the courts, federal or state. Judicial corruption and activism is a cancer that has grown over the years thanks to the cowardice of the Outlaw Congress in their failure to remove bad judges. The same applies at the state level.

For those who do not take seriously what is happening, you ought to take the time to read The Rise and Fall of The Third Reich: A History of Nazi Germany by William L. Shirer; a massive tome of 1140 pages. Or, this superb article by Jacob G. Hornberger (Sept. 2006): How Hitler Became a Dictator. The same path to totalitarian government has been underway for years.

Again, I ask, what are YOU going to do about our dire situation?

Complain? Threaten to throw out your congress critter in Nov. 2012? Maybe write another letter for which you will receive the same doublespeak you’ve been getting from Rep. Fool for years? Call into talk radio? Make big testosterone talk? How about all the new columns that will now be written about the NDAA protesting what Soetoro signed into “law”?

Will any of those actions stop tyranny?

All my life I have been a staunch supporter of the Second Amendment. Our God given, natural right to own and bear arms. It wasn’t until 2005 when Dr. Edwin Vieira began writing his scholarly columns about the Second Amendment I realized I didn’t know squat. I knew what part of the Second Amendment said, but I had absolutely no idea what the first few words actually meant regarding the right to own and bear arms:

A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

Now, before Napolitano and her henchmen from the massive waste of money called the Department of Fatherland Security get a thrill up their legs, the constitutional militia is not to overthrow the government or to go to war against the government. America can thank the foolish out there (especially law enforcement agencies) who believe the lies spewed by the freedom hating money bags at the Southern “Poverty” Law Center regarding “a well regulated militia” as being something so vile, even use of the word militia is akin to cursing.

Nothing could be further from the truth as I learned over time by reading Edwin’s columns and his book, Constitutional “Homeland Security,” Volume One, The Nation in Arms. I also re-learned what I had forgotten from school about the history of this country and the power of the purse and sword:

“When evil men take office, the whole gang will be in collusion. They will keep the people in utter ignorance and steal their liberty by ambuscade. A standing army we shall have, also to execute the execrable commands of tyranny. Your guns are gone! What resistance could be made?”

Will you assemble and just tell them? Even if you could assemble, how will you enforce rightful punishment when due? Your guns are gone!

“My great objection to this government is that it does not leave us the means of defending our rights, or waging war against tyrants. Have we the means of resisting disciplined armies, when our only defense, the militia, is put in the hand of the congress?……Oh, sir, we should have fine times, indeed, if to punish tyrants, it were only necessary to assemble the people.”

Let Mr. Madison tell me when did liberty ever exist when the sword and the purse were given up from the people? Unless a miracle shall interpose, no nation ever did, nor ever can, retain its liberty after the loss of the sword and the purse. Guard with jealous attention the public liberty! Suspect everyone who approaches that jewel. Unfortunately, nothing will preserve it but downright force, and whenever you give up that force, you are inevitably ruined!”

The media feed this in order to keep readers reading and viewers viewing. The history of American elections has always been one of vituperation between the parties, so there is nothing new about this. Indeed, since so much depends on it, the political free-for-all is a healthy exercise.

It can, however, make for a difficult environment in which to go about one’s life; the air filled with charge and counter-charge, polls going up and down, and a general sense that something is very wrong with the way the government functions.

On the bright side, a gridlocked Congress may bring a measure of relief to everyone. Writing about gridlock in January 2011, Marcus E. Ethridge, a professor of political science at the University of Wisconsin, noted that “By fostering gridlock, the U.S. Constitution increases the likelihood that policies will reflect broad, unorganized interests instead of the interests of narrow, organized groups.” In 2011, we saw what happens when advocates of “renewable energy”, wind and solar power, or electric cars, get priority over the needs of most Americans for reliable energy and transportation.

At the heart of the 2012 election will be the recognition that the economy is still not recovering, that government is seeking to extend and expand its control over our lives, and, even among former supporters of Barack Obama, that he has been a failure of historic proportions.

A Friday Rasmussen Reports said that “Voters right now give the edge to Republicans when asked which political party is likely to win the White House and control both the House of Representatives and the Senate in next November’s election”, adding that “a lot of voters are undecided.” Those voters may actually wait until entering the polls to cast their vote.

Another bad piece of news for President Obama is a new comparative analysis of current voter registration data in key electoral states of Nevada and North Carolina. According to the Center for Information and Research on Civic Learning and Engagement, there has been “a drastic drop from 2008 levels when a record-high proportion of young Americans turned out overwhelmingly to cast their votes to elect Barack Obama as President.” This is significant because more than two-thirds of young voters supported the Obama/Biden ticket in 2008.

The President had a low moment following the passage of Obamacare that transformed itself into the Tea Party movement and an even worse one in 2010 when it propelled a large number of Republicans into the House of Representatives, causing its control to change hands. He has had, in fact, only one truly high moment and that occurred when he announced the killing of Osama bin Laden in May 2011. At the time, he typically took complete credit. In a speech at Fort Bragg to returning troops from Iraq, the word “victory” was never spoken.

Americans are not unmindful that the downgrade of the rating of the nation’s sovereign debt, the first in the nation’s history, was announced on Obama’s watch. The rate of “official” unemployment has receded to 8.6% but most Americans are well aware that it is far closer to 11% or more. America continues to experience that longest period of long-term unemployment since the 1930s.

For these and a myriad of other reasons, there is little reason to conclude that President Obama has any chance whatever of being reelected. The widespread contempt for Congress is also a hopeful sign for change. These are reasons to remain calm amidst the din of electioneering in the months ahead.

There is, however, all manner of troubles brewing in the world. Europe will have to find a solution to what will happen if its southern tier of nations elects to default on their sovereign debt. Cracks in the European Union are evident. If it falls apart, it will be very messy, but Europe existed before the EU and would if it disbands.

The Middle East is in the midst of a huge struggle between its fanatical Muslim faction and a population unhappy enough with former dictators to have forced out several in 2011 with the prospect that Syria’s Bashar Assad will fall in 2012.

Iran remains the wild card and its nuclear dreams will likely end with a well-timed and well-executed attack by Israel. Israel saved the world from a nuclear Iraq in 1981 and a nuclear Syria in 2007. An attack on Iranian nuclear and military facilities could trigger an internal movement to overthrow the mullahs.

There are other wild cards in the Middle East. The Palestinians show no indication of giving up their dream of destroying Israel. That will not happen. Without Iranian support, both Hezbollah in Lebanon and Hamas in Gaza will be set adrift. Muslim atrocities in nations such as Nigeria where Christian churches were bombed on Christmas Day will contribute to a growing movement against Islamic terrorism. It will not happen overnight, but it will happen.

Even the Russians show signs of tiring of their post-Soviet ruling class led by Vladimir Putin.

America faces a long period of restructuring the socialist programs that began in the 1930s and reached their peak in the 1960s. Should the GOP gain control of Congress and Obama is defeated, real change will occur.

Two other factors signal better times ahead. They are the failure of the global warming hoax and the disdain the “Occupy” movement engendered.

In 2012 Americans will take steps to end the scandals and deprecations of the Obama administration.

We shall ignore the anticipated shouts of racism.

We shall see the Supreme Court disembowel Obamacare or set in motion its repeal by a GOP controlled Congress.

We will select a President and a Congress to put things right.

1. President Obama must be defeated in 2012 and the obstructionist Democratic Party must lose power in the Senate to ensure both houses of Congress will be Republican and in a position to initiate real change.

2. The Environmental Protection Agency must be reined in with increased Congressional oversight and legislative limits on its rule-making capacity. Having fulfilled its 1970 mandate to clean the nation’s air and water, it should be scaled back to the maintenance of these functions.

3. Americans, despite the administration’s efforts to redefine and distract us, must keep clearly in mind the threat of Islam to the nation and the world. A Middle East in turmoil lays ahead for 2012.

4. To jump-start the economy, taxes and spending must be reduced across the board. A tax on consumption, rather than income would be a good start. Only 49% of Americans currently pay income taxes, the lowest in decades.

5. Obamacare must be repealed should the Supreme Court fail to rule that the Commerce Clause takes precedence over its requirement that Americans must purchase health insurance or be fined for not doing so.

6. A serious restructuring of Social Security and Medicare must be undertaken. Older Americans who have paid into the system—it is involuntary—must be ensured their benefits will be paid, but younger citizens should have the freedom and responsibility to structure their own retirement and health plans.

7. Access to the nation’s vast reserves of coal, natural gas, and oil should be increased and encouraged. Oil companies should be encouraged to build more refineries via tax credits and removal of “environmental” obstacles.

8. Congress needs to identify and fund the repair to the nation’s aging infrastructure.

9. Utilities should be encouraged via tax credits and other incentives to expand the national “grid” for the distribution of electricity.

10. Term limits for Senators and Representatives should be added to the U.S. Constitution in the same fashion the presidency is limited. Salaries, pensions, and perks should be capped. A permanent political class is a danger to citizens.

11. The Federal government should be downsized with the elimination of the Departments of Education, Labor, and Energy, along with the Environmental Protection Agency. These powers should be returned to the individual States. (10th Amendment)

12. The nation’s military which has been significantly reduced in size and structure should be expanded with attention to the upgrade and increase of its naval fleet and aircraft.

13. Congress should reject and rescind all legislation based on “global warming” or “climate change” as the former has been demonstrated to be a hoax and the latter is meaningless insofar as the climate is beyond the control of humans.

14. The United States should significantly reduce its contribution to the United Nations and refuse to ratify any of its treaties.

15. Tort reform should be instituted to reduce the costs of health care.

16. The corporate tax rate should be significantly reduced from its present rate, one of the highest in the world, to increase expansion, new jobs, and competitiveness.

17. Public service unions should be illegal. The federal government does not permit such unionization and neither should states.

18. National Public Radio should no longer be funded. The “government entities” of Fannie Mae and Freddie Mac should be eliminated.

19. The federal government should be restricted or significantly limited from the acquisition of more of the nation’s landmass.

20. Strenuous efforts must be undertaken to reduce the national debt and deficit. A devalued dollar impoverishes everyone.

These are just a few changes which, if implemented, would go a long way to reducing the ills associated with a federal government grown too large, subject to crony capitalism, and corruption.

As John Adams said, “Let us disappoint the men who are raising themselves upon the ruin of this Country.”

Notorious Republican lobbyist Jack Abramoff is back on what the late Watergate scandal participant, John Ehrlichman might term a “modified limited hang out” book tour.

Abramoff contends that Washington equals swamp and the only reason he went to jail, for what he claims is standard operating procedure, is Jack made the mistake of raising his head too far above the scum line.

Jack’s obvious continuing pride in his accomplishments on behalf of his clients is cause to doubt sincere contrition on his part. And Abramoff appears blissfully unaware that the reputation he earned and scandal he created are in large part responsible for the GOP losing the House in 2006 — or if not unaware, he’s certainly unrepentant.

Still, Jack took advantage of the “me time” the feds gave him in Cumberland Prison to propose two reforms to clean up some of the mess he reveled in before his unfortunate incarceration.

First, he recommends that lobbyists, recipients of federal contracts and anyone who benefits from public funds be prohibited from making contributions or providing gifts to those in power. This alone covers everyone from General Dynamics to residents of Section 8 housing. Then he adds to his impossible dream by calling for a lifetime ban on lobbying by Members of Congress and their staff.

Conservatives automatically suspect any contribution prohibition because contributions are a form of speech. Yet I’ve never been entirely sold on the idea that semi–Socialist George Soros’ speech should forever be exponentially louder than mine, given the disparity in our bank accounts.

Counter–balancing conservatives like the Koch brothers grant what little peace of mind I have. (For conservatives the best of an uncertain situation would probably be to return to the unlimited contributions regime that existed before the “reforms” with the addition of unlimited and immediate disclosure of the donor.)

Campaign contributions from companies and individuals that take government money are inherently incestuous. It’s quite possible that most of the money that comprises the contribution originated as tax dollars before it was washed through the contractor’s accounts.

That’s one reason I like the idea. The other is the restriction is voluntary: don’t take the government check and you can contribute to your heart’s content. Even those affected by the ban face only a limited imposition on political speech. They can still give to state and local candidates, they can give to parties and they can spend their money on independent expenditures.

Speech bans already exist without undermining the Constitution. For example, individuals with a Top Secret clearance are prohibited from discussing the secrets in public, which is a limit on speech. Judges aren’t allowed to discuss cases while the trial is in progress, which is another voluntary limit on speech. So how does the prohibition on contributions differ?

Precedent for the equally voluntary lobby ban already exists in a limited form. Congressmen, Senators and staff are currently required to wait one year before they can board the lobby gravy train. Abramoff’s idea just extends the time limit to forever.
Politicians become lobbyists after leaving office because they’ve been captured by Washington and joining the permanent political class just seems like the thing to do. The constituents, who were fine as long as they were providing votes, are no longer up to snuff when it comes to being neighbors.

This voluntary rule — combined with term limits, which has also has a new supporter in Abramoff — would do much toward ridding us of the professional politician who’s only goal in life is serving in big government where he can “be a positive force for change.”
Three good ideas, regardless of the source, that have as much chance of being enacted as Ron Paul does of being President.

The Threat of a Global Financial Collapse

At present, the amount of the annual Gross Domestic Product, $14 trillion—the value of all the goods and services that generate income—is exceeded by the nation’s debts.

America is presently $15 trillion in debt and it grows daily.

In a November 21 Wall Street Journal interview, Erskine Bowles of the presidential advisory commission on the nation’s debt, said “If you take 100% of the revenue that came into the country last year, every single dime of it was consumed by our mandatory spending and interest on the debt.”

“Mandatory spending in English is basically the entitlement programs, Medicare, Medicaid and Social Security. That means that every single dollar we spent last year on national defense, homeland security, education, infrastructure, high-value added research—every single dollar was borrowed, and half of it was borrowed from foreign country.”

“That’s a formula for failure in anybody’s book.”

In truth, we are looking at a coming global financial collapse with experts from Credit Suisse to the Deutche Bank, the CEO of General Motors to Warren Buffett, all in agreement that the question is not if, but when.

It will come at a time when there is little, if any, real leadership to be found either in the U.S. or Europe, the most spendthrift of nations facing this crisis.

Thomas Jefferson, one of the most brilliant of our Founding Fathers, said “I predict future happiness for Americans if they can prevent the government from wasting the labors of the people under the pretense of taking care of them.” He also said that “It is incumbent on every generation to pay its own debts as it goes.”

Another Founding Father, James Madison, warned Americans against the concentration of power saying, “I believe there are more instances of the abridgement of freedom of the people by gradual and silent encroachments by those in power than by violent and sudden usurpation.”

Over the years, more and more power has been concentrated in the federal government and it requires the dismantlement and elimination of several of its components. Americans need to say no to the Departments of Education, Energy, along with the Department of Housing and Urban Development. These are all functions previously addressed by the states.

You will not find any of these activities specified in the Constitution. Consider when they came into being:

Education was established in 1953, originally as the Department of Health, Education and Welfare. In 1979, it was subdivided into Education and Health and Human Services.

The Department of Housing and Urban Affairs was created in 1965.

The Department of Energy was created in 1977.

Thus, between 1953 and 1979, a period of 26 years, the federal government took control of key factors of the nation’s affairs, most if not all are dealt with far better at the state and local level.

To these must be added Freddie Mac and Fanny Mae, two government “entities” responsible for the housing mortgage crisis and currently asking Congress for billions more to cover their losses.

The Tenth Amendment of the Constitution specifically says that “The powers not delegated to the United States by the Constitution, nor prohibited by it by the states, are reserved to the states respectively, or to the people.”

Congress is filled with men and women for whom their position has become a sinecure as they are elected and reelected, some for decades But Congress has proved itself unwilling to govern the financial affairs of the nation. A recent vote in the House rejecting a proposed balanced budget amendment reflects this.

In 2012, the voters will have the opportunity to reverse this failure, electing men and women who will vote for term limits, a balanced budget amendment, and other necessary changes.

We have witnessed what happens when Americans lose sight of the vision of our Founding Fathers and the Constitution they bequeathed to posterity.

We are that posterity.

The present generations of Americans are obligated to save the nation or see it fail.

Reasons for EVERYONE in Congress to Repeal ObamaCare

There are few opportunities for legislation that holds the prospect of gain for EVERYONE who supports it, regardless of party or ideology – but amazingly, the repeal of ObamaCare offers that very opportunity, if our elected officials would but examine the possibilities!!

First and foremost, the majority of America rejects ObamaCare and supports its repeal. So you’ve got popular support. For the Democrats, that majority thing ought to be a biggie. After all, they’re all about direct democracy, aren’t they? Majority rules, right?

But as I’ve been quick to point out on many occasions, not everything that’s popular is right, and not everything that’s right is popular, so let’s look at some other motivations that might move our members of Congress to action.

Dems should consider that ObamaCare is about to undergo a major review by the Supreme Court. Even with Kagan participating and not (properly) recusing herself from the case – there is a very strong possibility that at least some part of ObamaCare will be struck down – if not in its entirety! This would deal a major blow to the party that rammed it through without a single GOP vote, after arm twisting and bribery by Pelosi, generally UNREAD, which had to be PASSED so we could know what’s in it! Not only was it bad law, passed in an unscrupulous manner against the will of the people, but SCOTUS will also give the slap of unconstitutionality to at least part of it. That stings.

Why not get out in front of this and defuse it by repealing ObamaCare and making a SCOTUS review moot?

And likewise, GOP, what if SCOTUS only finds PART of ObamaCare unconstitutional? Do you want to HAVE to live with any part they find legit enough not to strike down? Are you confident that Kennedy will hang tough with the conservatives on the Court ENOUGH to do away with ObamaCare? What kind of mixed bag of upheld and struck down provisions might we have to contend with?

But hey, Republicans, here’s the BEST reason to move on repeal. YOU PROMISED TO! You were ELECTED to! The whole point of the Mid-Term Elections was to put you in a position to. And you’ve forgotten all about it. That will not sit well come primary season!

Back to the Dems. Since you took the reins of Congress in January 2007, we watched the deficit climb from 120 Billion at the end of GOP control of Congress, to nearly 15 times that amount at 1.7 Trillion. We watched the National debt climb from 6 Trillion after 6 years of Bush and 2 wars to nearly 14 Trillion in 4 years of Pelosi/Reid. So whatever Bush Bashing you may do, and however much you seek to blame Bush and say Obama INHERITED his problems… the American People understand that you are the party of spending with reckless abandon. A reality, and a perception you may do well to strive to reverse!

The Super-Committee is charged with finding a Trillion in cuts over 10 years. A pittance! That’s really only 100 Billion a year… and they can’t do it! If the automatic cuts kick in, the military will be slashed, and lefty ideologues aside (as they represent only around 20% of the population) the people of America DO NOT want to see the military slashed by 500 Billion!

Repealing ObamaCare will save TRILLIONS over a decade. All by itself. Your precious spending programs don’t even have to be touched, and you can claim victory in achieving the spending reduction!

For the GOP, repealing ObamaCare is a victory fiscally, and ideologically, protecting individual rights, reigning in an egregious over-reach by the federal oligarchy.

For all of you. Repeal would result in an economic recovery far exceeding the wildest dreams or expectations of any program or stimulus the Administration has considered, offered or implemented! Companies, freed from the shackles of ObamaCare, would loosen the hiring constraints. Jobs, production, GDP and tax revenues would all climb – and true to Reagan’s quote… a rising tide does indeed lift all boats. And you could all claim credit for stimulating the economy out of the worst “recession” (depression) in our lifetimes at least!

Back to the Dems. Are you REALLY supportive of affordable healthcare for people? Then realize how many companies are ready to ABANDON providing care when ObamaCare is fully implemented!! I know many of you are idealogically committed to Single-Payer healthcare, and such a collapse of the private and employer provided market would leave a vacuum that you’d feel compelled to fill with Government care… but America resoundingly doesn’t want it! Given the choice between the private enterprise Hospitals like Barnes, Mayo, Mt Sinai, or Hopkins, and government care like say, a VA hospital, which do you think most Americans would opt for? Even if they pay for private insurance?

If ObamaCare is SO GOOD for people, why the waivers for so many FOD’s (Friends of Democrats)? And why is Congress exempt?

ObamaCare is a boondoggle. It’s an embarrassment to the Dems and CAUSED the massacre of 2010. It’s impractical. It’s unsustainable. And eliminating it will save TRILLIONS.

Truly. WHAT are y’all waiting for? How about a nice Christmas present THIS year? America said THANK YOU for Pelosi’s Christmas Present of 2009 with the November 2010 elections. Repeal for Christmas 2011 would be a present America would TRULY appreciate!

Every so–called idea in the speech was recycled from the extensive collection of failed Obama stimulus programs.

What did appear to be new was the increasing level of desperation in Obama’s demeanor. He’s a man who knows he’s on a sinking ship because his socks are getting squishy.

He’s gone from the cool, noble, Führer <http://en.wikipedia.org/wiki/F%C3%BChrer> of the Future to the Nag of our National Nightmare. I lost count of the number of times he whined, “Pass this jobs plan.” It would have been a more convincing performance if Michelle had been ordering Congress around. Obama did everything but tap his foot and shake his finger in Speaker of the House John Boehner’s face.

(And speaking of faces, did you notice Boehner’s? Maybe it was the lighting, but I could have sworn his complexion was darker than Obama’s. I think we may have the first black or at least Indigenous American Speaker of the House, but of course the mainstream media ignores a story that might make Republicans look good.)

In keeping with his policy of relaxing the administration’s grasp on reality, at the time of the speech there was no ‘Save Obama’s Job’ bill for Congress to pass, because nothing had been introduced. And just like the Congressional Budget Office does not estimate Obama speeches, the House does not pass speeches. It only endures them.

Obama grants awesome powers to his non–existent bill, “It will provide a jolt to an economy that has stalled.” Yet he keeps hooking the electrodes up to the same dead battery.

First there is $140 billion for “infrastructure.” This is Son of Shovel–Ready jobs. The only way the $50 billion allocated to bridges and infrastructure will be spent in a timely fashion is if he’s prepared to ship environmentalists off to Guantanamo. The kudzu of regulation and lawsuits surrounding road, bridge and transit funding guarantees paralysis. Just like it did the last time.

Besides, I think every illegal that wants a construction job already has one.

Then there’s the $35 billion handout for teacher’s unions and ‘first responders.’ Lucky for them most of these government workers already have jobs and since the money is a one time BINGO! experience, cities with budget problems that rely on this money to meet payroll expenses will be in the same situation next year.

So much for “investment.” Next up are tax cuts. Tuesday we learned Obama’s one year of tax cuts will be paid for by a decade of tax increases, which is about the usual Democrat exchange rate when it comes to spending.

Time stops for the Obama administration on Tuesday, November 6, 2012, so his planning horizon is just over a year. But that’s not the way it works for business. One year of tax cuts followed by ten years of tax hikes is not a ratio that’s going to inspire confidence in the business community.

Smart businessmen will continue to sit on their cash until the future looks Obama–less. Net jobs created: Zero.

The same is true for the individual taxpayers and the payroll deduction decrease. Over the course of a year it will average out to a $1,500 tax cut, but Obama doesn’t drop it off at your door in a lump sum. It comes in $125 installments. Families aren’t going to rush out and spend the money in this economy. The additional money will be used to pay down debt or be squirreled away in savings, just like it was when Bush tried this ploy and when Obama copied it later. Net jobs increased = none.

Finally comes $62 billion for the currently unemployed. Extending unemployment insurance will cost $49 billion. This may be a boon for the jobless, but it won’t get them work and it won’t get anyone else a new job either. The rest is tax credits for hiring the long–term unemployed and “work opportunities.”

Here again we encounter the time mismatch. The tax credits are for a single year, then the old rates resume along with the decade of tax increases planned by the wallet–emptiers in Obamaland.

Obama’s idea of job creation is to throw good money we don’t have after bad money we never had either. He shouldn’t be asking Congress for permission, Obama should be checking with the Chinese ambassador.

There are a number of actions Obama could have proposed if he was serious about job creation, but these are not among them. And that’s because right now the only job Obama is really interested in is his own.

By SARTRE

The recent debt limit congressional circus must be a new Twilight Zone episode written by a computerized program straight out of central casting. Rod Serling must be turning in his grave. A twenty-first century rewrite of his exceptional Seven Days in May screenplay is certainly in order, this time with a different ending. If there are any confused or co-opted worshipers of the federal government left, what more proof do you need that the bipartisan political criminal class is determined to destroy this nation? Not convinced that this assessment is correct; then you need remediable instruction in arithmetic. Increasing the spending with more borrowed money cannot reduce the debt.

The world financial markets are voting with their money, that the U.S of A. will no longer be the leader of free market enterprise. The flow of hot money into Treasury Bonds is tantamount to feeding the alligator with the hope that eating forged paper will forgo its appetite for flesh. This is the same strategy used to shackle market makers and docile societies into accepting, that the world financial system must be saved from their own greed and pillage, so that the dependent vassals can continue to pay their tribute.

The beltway bottom feeders know just how to scare their pudden-head constituents. With the complicity of the corporate controlled media, the task of getting away with murder has been elevated to a supreme political art form. ‘Pols’ can fool some of the public with all the false causes and bogus reasons for the dysfunctional federal government, but can they escape the distrust in their deal making skills, that never resolve any substantive issues? Even the current New York Times and CBS poll, cannot hide the disgust with an 82% disapproval sentiment.

This level of discontent is expected by anyone who understands the decade’s long destruction of the fundamental nature of the “federalism” form of the separation of powers principle. Many observers recognize the gross offense of adopting a gang of 12 approach for shepherding their flock in Congress to accept the dictums in the Amerika version of the Soviet Politburo.

Cited in The New American, the good Napolitano, Judge Andrew weights in correctly.

“Napolitano raised another — and unassailable — objection to the legislation. Napolitano noted: “This is this Congress binding itself and all future Congresses to a simple up-or-down vote.” In that sense, the new “Super Congress” joint committee is truly revolutionary, and unquestionably unconstitutional. Under the Constitution, no Congress can bind a subsequent Congress with rules of procedure, which is why one of the first acts of every new Congress after an election is for the House and Senate to separately approve new rules.”

Our friends over at Prison Planet quote the indomitable Larry Pratt.

“This is a game changer, they’ve decided that we don’t need the House of Representatives to originate revenue bills, we’ll just have the ‘super 12′ do that,” said Pratt, adding that Barack Obama would become the de facto deciding 13th member.

Legislation decided on by the Super Congress would be immune from amendment and lawmakers would only be able to register an up or down vote, eliminating the ability to filibuster.”

This attempt to relegate the House and Senate to water boy status is clear proof that the first causality of the federal dictatorship is to eat their own noncompliant elements in the legislature. When a NeoCon disinformation and newspeak publication like The Weekly Standard jumps on the bandwagon, you better grab your ankles. “Three Republican Senate sources tell TWS that senators who vote against the deal will be ineligible to serve on the so-called “supercommittee” for deficit reduction that the legislation creates.”

Purity of ideological devotion to the globalist integration of the former Republic is the true test of a collectivist commissar. Two world wars later and several police action conflicts removed, the extension of the garrison empire continues to expand. Name any definitive benefit that the populace gained from all the squander of treasure and the shedding of blood. All the time the bulwark of constitutional limited government is systematically dismantled.

The unfettered growth of government is the only reality that matters to the federal fascists. An economy that relies upon government spending for continuation is a zombie zone of the walking dead. The alternate media presents unending examples of this death march onto reservation of predatory prisons. An isolated cell awaits – with a number in place of your name. The silence of most occupants in the land of the timid breeds the sterile culture of fearful chickens. What more evidence does any citizen need that the federal government is organized and posed to repeat the same atrocities’ that totalitarian regimes committed in the last century?

What makes it much more acute is that a net of surveillance and a draconian database covers the entire globe. The satellite spy in the sky era extends to every aspect of communication, financial transactions and personal activity. The land of the free is now the camp of the interned.

How paradoxical, when you hear the regurgitation from progressive government lovers, that the federal and state agencies provide solutions, when the real irony is that these numb nuts are clueless what true populism represents, much less how to achieve a humane society.

Folks, the enemy have just declared itself as the Washington establishment and you are in the sniper sights of their full spectrum dominance scope. Research to your hearts content all the dire consequences of the despotic cabal that masquerades as your elected representatives. Notwithstanding, the pace of your own personal awakening; without direct and focused action, your fate is sealed.

An entire nation is not helpless resisting tyranny if citizens rebel. Only if you prefer denial to self-respect will the forces of treason prevail. Many Americans are not committed to liberty, and most fear personal responsibility of their own individual obligations. The hoi polloi never change history; they just accept the outcome. Isn’t this a prime reason why the Federal government continues to go on its merry way? The entire apparatus of the illegitimate bureaucracies steers the suppression of the will of the people.

The Obama nightmare is just one more leg in a complex plan to destroy the aims and purpose for fighting the American Revolution. The excessive conduct of federal loyalists loves their abuses of the public trust. When DC continually spends the people’s money and never has to pay back the unlimited loans, the lifestyle of the rich and famous, becomes part of government pensions and perks. There is no gambling risk or prospect of a loss as long as the taxpayer and future generations are providing the stakes.

There has never been a true civil war in this country. The War of Northern Aggression was waged precisely to prevent the Southern States from secession. The prospects of an enlightened and dedicated population taking up arms and defeating the military-industrial-security-complex require a miracle . . . turning water into wine. The creatures that dwell in this country are cloned cowards afraid of their own shadow. Forget about armed confrontation. Any attempt using violence plays into the hands of the Gestapo state.

However, developing a civilization of respectable civil disobedience is entirely in keeping with the best tradition of Western culture and Judeo-Christian teachings. Doubters can examine the recent book by Chuck and Timothy Baldwin, ROMANS 13: THE TRUE MEANING OF SUBMISSION for validation.

The federal government’s war against the Inherent Autonomy of the individual is the greatest danger to your own sustained existence and the survival of the nation. There is no way to reform a totally corrupt and crooked system of criminals. Families are being added to the extinct species list every day by a government that codifies same sex marriage and encourages abortions. Stating this factual axiom of civilized behavior is an unforgivable taboo to the Statists, who want the power over life and death and the eventual eradication of the family structure.

The core natural right and principle of individual self-defense is sacrosanct. Resistance to a despotic presidency and a crippled congress is a moral imperative. Defending, fighting and dying for the State, especially when that government is targeting you for annihilation, is absurd. The obvious elimination of witnesses to the diversion bin Laden raid illustrates just how ruthless the rogue government acts, even to their own special troops.

“A military helicopter was shot down in eastern Afghanistan, killing 31 U.S. special operation troops, most of them from the elite Navy SEALs unit that killed al-Qaida leader Osama bin Laden.”

The unceasing slurs against the Tea Party movement by a scared system through the misdirection media and their globalist masters is a sure sign that citizen participation in the political process is an act of resistance against the evil empire. The warfare state has mobilized against the American rebels. As the financial temple collapses and prices escalate, the pressure for “PC” compliance spreads like wildfire. Singling out selected dissenters for retribution requires the rest of the country joining in an uproar of protest.

Your life is at stake, ban together for dynamic resistance and confrontation. There is no other alternative. The Federal Government has started another undeclared war, but this time their homeland security proceeds to eradicate all real patriotic citizens and champions of liberty. This Twilight Zone episode needs a conclusion where the mythical Jordan Lyman ( no matter what name he uses ) is removed and all ensuing presidential treason is justly punished.

Obama Abusing The Bully Pulpit

Obama’s speech to a joint session of Congress concerning jobs is nothing more that a campaign speech. This is more of Obama abusing the powers of the Office of the President and conservatives in the Congress should boycott it. It is just high political theatre and frankly it is another tasteless move by the White House.

Scheduling the speech on the same evening as the GOP debate at the Reagan Library (the first debate in which Rick Perry will take part) is a deliberate maneuver to create a press boycott of the debate. It is juvenile and heavy handed. It is beneath the Office of the Presidency. As we folks down south say: “It is tacky!”

The White House’s explanation that the scheduling was merely a coincidence is pure bovine scatology! See, the President, and his coterie of imps, continue to believe that you and I are so dumb we will believe that sort of elementary school pabulum. It is out and out nonsense.

I urge the House of Representatives to refuse passage of the resolution allowing the President to speak to a joint session. It is certain the Senate will pass such a resolution. But in order for the event to happen, BOTH houses of Congress must pass the resolution. I hope the House has the good sense to deny it passage.

Speaker Boehner sent a letter to President Obama in which he said the following: “As you know, the House of Representatives and Senate are each required to adopt a Concurrent Resolution to allow for a Joint Session of Congress to receive the President. And as the Majority Leader announced more than a month ago, the House will not be in session until Wednesday, September 7, with votes at 6:30 that evening.” The Speaker continued: “It is my recommendation that your address be held on the following evening [Thursday], when we can ensure there will be no parliamentary or logistical impediments that might detract from your remarks.” (You may read the entire letter from Speaker Boehner to President Obama HERE.)

It looks like what it is: A bully in the Bully Pulpit!

I get the feeling this President actually LIKES throwing his weight around. He never misses a chance to remind us HE is the President with his multiple usage of the words “me” and “I” and “mine.”

In his letter to the Congress, the President said: ““It is my intention to lay out a series of bipartisan proposals that the Congress can take immediately to continue to rebuild the American economy by strengthening small businesses, helping Americans get back to work, and putting more money in the paychecks of the Middle Class and working Americans, while still reducing our deficit and getting our fiscal house in order.” Obama continued by saying: “It is our responsibility to find bipartisan solutions to help grow our economy, and if we are willing to put country before party, I am confident we can do just that.” (SOURCE)

It is pure boilerplate. It is just more of the same.

The President wants the American people to perceive him as doing something. In fact his “doing something” is what has kept the country in a mess and made that mess even messier. His actions and that of his regulatory agencies and his democrat cohort in the Senate have created an atmosphere of uncertainty in the American business community and frozen business in its tracks. Business cannot grow and jobs in the private sector cannot be created when risk is perceived to be too high due to the uncertainty the Obama Administration has brought down on the job creators in America.

If, and when, Obama and his regulatory agencies get out of the way, the American economy will grow by leaps and bounds. Jobs will not be created until that happens.

OK. Obama has proven he knows how to create government jobs. But those jobs have only made private job creators even more reluctant to put their necks and their cash on the line.

Look. It is becoming ever clearer as the days go by that America is frozen in place until the Obama Administration is shown the door. American business is ready to roar back to life. They are in a leaning forward posture … but … not until Obama and his administration is out of the way.

Whatever Obama says in his speech to the joint session of Congress will be of no import to anyone but Obama and his campaign.

We have warned time and again that this campaign will likely be the dirtiest in history. Obama’s shock troops, the labor unions, don’t mind rolling in the gutter to get their man across the finish line first.

Republicans had better sit up and take notice. The GOP had better field a nominee with the ability to fight with bare knuckles and even hit below the belt when it is advantageous. This campaign will make a barroom brawl look like a Sunday School picnic.

The GOP needs a brawler not a mild mannered impeccably coiffed, manicured, “nice guy” with a gleaming smile. What is called for is a nominee to carry the GOP banner and attack, attack, and attack, and keep Obama reeling and unable to organize a counter-attack. You can be sure the democrats will adopt the aforesaid strategy. And they are darned good at it.

America needs a warrior and not a limp-wristed lawyer to lead this nation back to her place as the engine of democracy and the guiding light for all men everywhere who seek freedom and a fair shake at fulfilling their dreams.

We NEED America back. The WORLD NEEDS America back.
