Amendment to the U.S. Constitution:</strong><br />
Section 1.</p>
<p>“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law, which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.”</p>
<p>There is the problem &#8212; section one of the 14th amendment. It HAS to be changed.</p>
<p>How many “legal” Americans understand that over 300,000 babies are born to illegal immigrants, every year, here in the states? (Actually, the figure is closer to 350,000 babies born each year in the US to illegal aliens.) The US continues to be the only nation that still allows so-called “Anchor Babies.”</p>
<p>Just so we are clear on exactly what an Anchor Baby is &#8212; the term “Anchor Babies” is used to identify babies born in the US from illegal alien mothers.</p>
<p>Under the Immigration Act of 1965, Anchor Babies can, at the age of 21, bring in their family as permanent residents of the US.</p>
<p>In 1866 Senator Jacob Howard explained the original intent of the 14<sup>th</sup> Amendment to the constitution. He said: “Every person born within the limits of the United States, and subject to their jurisdiction, is by virtue of natural law and national law a citizen of the United States. This will not, of course, include persons born in the United States who are foreigners, aliens, who belong to the families of ambassadors or foreign ministers accredited to the Government of the United States, but will include every other class of persons.&#8221;</p>
<p>As every year passes more and more illegal aliens are taking advantage of American largess by breaking and entering the United States illegally and having their babies on US soil effectively anchoring their family in the US through the instant citizenship of that baby. This can no longer be allowed.</p>
<p>It is past time for the United States to either enforce the 14<sup>th</sup> amendment, as it was originally intended, or amend the constitution to outlaw “Anchor Babies.”</p>
<p>The lines are already forming while the new Congress has barely warmed the cushions of their seats.</p>
<p>The US is, for all intents and purposes, BROKE! And yet we continue to allow illegal aliens to bleed us even drier. US Taxpayers are footing the bills for their birth, medical care, their education, (even college), and their food, darn near everything. Uncle Sam has become Uncle Sucker!</p>
<p>Some in Congress say we can correct this situation with another law. I don’t buy it and here’s why: A law will not stand the scrutiny of the US Supreme Court. (At least not the liberal court we have now.) So, the only way to get any kind of citizenship reform that actually works &#8212; is to amend the US Constitution. You can believe if an amendment was passed by both houses of the Congress, and signed by the President, ratification by the states would come almost overnight.</p>
<p>The fly in the ointment, at the moment, is, of course, the President. Obama will never sign anything that might slow the flood of illegal aliens (or as some refer to them “Undocumented Democrats!”) into the US. There is no way he would ever sign an amendment to the constitution that would put a stop to looting of the US Treasury by anchor babies.</p>
<p>But the groundwork must be laid sooner rather than later. As we look toward the elections in 2012, with a eye toward a conservative take over of the Congress and the office of the President, we must be ready to seize the moment and get an amendment through and on to the states for ratification as early as possible in 2013 or 2014.</p>
<p>As evidence of the urgency some states are feeling there have been reports that a number of states are investigating the possibility of creating “STATE CITIZENSHIP.” To qualify for citizenship in those states a baby must be born with at least one parent a legal and permanent resident or citizen of the state.</p>
<p>We “legal” Americans have to take back our country. The flood of illegal immigrants and “Anchor Babies” must be stopped. We know how. The question now is: Do we have the will?</p>
<p>We know our divided government is wishy-washy on the issue. But little doubt exists that the majority of the American people have the will. We want it done and done quickly.</p>

<p>There is growing support within the GOP for the controversial idea, which has also recently been touted by Senate Minority Whip Jon Kyl (R-Ariz.) and Sen. Lindsey Graham (R-S.C.).</p>
<p>Senator McConnell said: “I think we ought to take a look at it — hold hearings, listen to the experts on it,” McConnell said. “I haven’t made a final decision about it, but that’s something that we clearly need to look at. Regardless of how you feel about the various aspects of immigration reform, I don’t think anybody thinks that’s something they’re comfortable with.”</p>
<p>Senate Minority Whip Jon Kyl (R-Ariz.) has said: “There is a constitutional provision in the 14th Amendment that has been interpreted to provide that, if you are born in the United States, you are a citizen no matter what. … And so the question is, if both parents are here illegally, should there be a reward for their illegal behavior?” Kyl went on to say: “We should hold some hearings and hear first from the constitutional experts to at least tell us what the state of the law on that proposition is.” Kyl’s Remarks were made on CBS’s “Face the Nation” last Sunday.</p>
<p>Sen. <p><strong>If you are a regular reader of our rants, then you know we have been calling for an end to the practice of “Anchor Babies” for a good long while now.</strong></p>
<p><em>Anchor babies</em> are children born in the United States to illegal alien parents. “<em>These children may instantly qualify for welfare and other state and local benefit programs. Additionally with the passage of the 1965 Immigration and Nationality Act, </em><em>the child may sponsor other family members for entry into the United States when he or she reaches the age of twenty-one (See also <a href="http://www.fairus.org/site/PageServer?pagename=iic_immigrationissuecenters3e2a">Chain Migration</a>).  The sheer numbers are staggering. </em><em>In Stockton, California (2003), 70 percent of the 2,300 babies, born in San Joaquin General Hospital’s maternity ward were anchor babies.” (From FAIR The Federation for American Immigration reform</em>. <p><strong>Section one, of the 14th amendment, was written to ensure that former slaves would enjoy full citizenship in the US. But, it has been stretched to encompass the babies of those who have entered this country illegally. Once that baby is born, they have their “anchor” here and, at age 21 that now “grown” baby, can petition the government to bring his family into the US as well.</strong><strong></strong></p>
<p><strong>It is estimated that 300,000, or more, anchor babies are born each year in the United States. </strong><em>The US is now the only country, which allows this practice.</em><strong> Ireland did, for a while, but quickly changed the law when it became obvious that pregnant immigrants from Africa were flooding their country every year. </strong><strong>The Anchor Babies instantly quality for a host of federal, state, and even local benefit programs. All of this happens as a result of the way the courts decided to interpret the 14<sup>th</sup> amendment to the US Constitution.</strong></p>
<p><strong>One must remember that at the time the 14<sup>th</sup> amendment was passed, <em>the United States had no immigration policy at all.</em> </strong>The amendment was added to our Constitution as part of the reforms (after the Civil War), which were intended to address injustices to African Americans. It states: &#8220;all persons born or naturalized in the United States and subject to the jurisdiction thereof are citizens of the United States.&#8221; It was worded in that manner to stop any state government from denying citizenship to anyone born in the United States.<strong> </strong></p>
<p><strong>Look closely at the wording of the amendment. Notice </strong>the phrase &#8220;subject to the jurisdiction thereof.” <em>The intention of that phrase was to exclude from automatic citizenship American-born persons <strong>whose allegiance to the United States was not complete.</strong></em></p>
<p>It is the belief of many in the US, today, that illegal aliens (who are in the US unlawfully, remember) have little, if any, allegiance to the US. At the very least that allegiance is “incomplete. Therefore, it logically follows that any children born of them, within the US, are NOT automatically United States citizens.</p>
<p>Action by Congress is needed, and needed desperately, to make clear, <em>once and for all,</em> that the 14<sup>th</sup> Amendment did not intend for children of illegal aliens, born in the US, to automatically become citizens.</p>
<p>It is time to lean on our Congresspersons and Senators <strong>and let them know how you feel about &#8220;Anchor Babies.&#8221; Let them know you want it stopped. Let them know you want the US borders sealed, and secured, and the illegal aliens already within the US </strong><em><strong>deported </strong></em><em><strong>– and &#8212; you want the 14<sup>th</sup> Amendment changed to put a stop to Anchor Babies </strong></em><em><strong>once and for all</strong></em><em><strong>. </strong></em></p>

Unlike the imaginary “violence” of the Tea Parties, these people actually RIOT!</p>
<p>Liberals are disingenuously claiming that the law somehow promotes racism or profiling. They’re likening the law to Nazi oppression. They discount the fact that the law does not authorize checkpoints, stopping people to check their status etc. It simply authorizes police, in the course of their normal law enforcement, to check the status of people stopped for other reasons, and to detain those found to be illegally present in the country. This is nothing more than allowing AZ law enforcement officials to enforce the Federal Law!</p>
<p>Current events prompt me to revisit the issue of illegal immigration. It’s been a couple years since I’ve written on the subject – not since the defeat of the McCain/Kennedy/Bush “Comprehensive Immigration Reform”.</p>
<p>The simplistic yet necessary opening statement on this topic is also the most obvious: “What part of ILLEGAL don’t people understand?”</p>
<p>LEGAL immigrants of all nationalities are welcomed and appreciated. The issue of illegal immigration should not be clouded by specious claims of racism or xenophobia. These straw-man arguments serve only to distract from the true issue: There are people who violate our borders without authorization and have no right to be in the United States .</p>
<p>That said, the fact remains that there are an estimated 12 to 14 million people residing in the United States without benefit of legal status. Democrats see them as a potential block of blue voters. Many Republicans who are beholden to business interests rather than constitutional conservative values view them as a source of cheap labor for their corporate campaign contributors. But the vast majority of the American public (and virtually every Conservative Patriot) views them objectively as what they are: illegal trespassers who are a drain on precious resources, who take jobs from citizens and legal residents, etc.</p>
<p>There are so many misconceptions and so much misinformation behind the arguments for amnesty that it is important to address these arguments directly.</p>
<p><em>“These people are just coming here to better their lives.”</em> OK – then come legally! To use this as an excuse for violating our sovereign borders makes as much sense as excusing a person who has been burglarizing the neighborhood so he could afford a better life for his kids! You don’t “better your life” by criminal activity!</p>
<p><em>“These are hardworking contributors to our economy.”</em> Really? Yes, many illegals ARE hardworking and industrious laborers working for sub-par wages. But by taking those jobs they not only displace a LEGAL employee, but they artificially depress wages. Is that good for the economy? And how many “hard working” illegals are offset by other illegals living on government largesse? What is the effect on the economy and on the health system when all members of a family of 12 receive health benefits off a single MediCal card… and use the emergency room as their primary physician?</p>
<p><em>“If all the illegals were deported, there would be no restaurant workers, Laundromat workers, landscapers etc.”</em> No, there would be a lot of “help wanted” signs, ads and postings! Unemployed citizens and legal residents would apply for and be hired for those positions. The economy would be strengthened as the unemployment rate would drop!</p>
<p><em>“We can’t deport 12 million people.”</em> We wouldn’t have to if we took the following common sense steps!</p>
<p>· SECURE the border and stanch the flow of illegal crossings</p>
<p>· Deport every illegal when encountered . No need to have a round-up… but when an illegal is discovered in the normal course of law enforcement – whether an arrest or a routine traffic stop… ship them back to country of origin – whether Mexico, Latin America, Bosnia, China or France!</p>
<p>· Strengthen sanctions against employers who hire illegals, and step up enforcement.</p>
<p>· DISQUALIFY anyone who is not a citizen or legal permanent resident from receiving ANY Government entitlements.</p>
<p>· DENY Citizenship, ever, for anyone who has violated our borders – regardless of any possible decriminalization or later legal residency.</p>
<p>· END the “anchor baby” problem by a constitutional amendment clarifying citizenship (I wrote on this subject in 2007: http://www.smallgovtimes.com/story/07sep09.citizenship.devalued/index.html</p>
<p>If it is harder to get in, and for those who are already here, the supply of jobs and give-aways are dried up and they get sent home when discovered, and they can’t drop a baby with automatic citizenship; the incentive to come will diminish and the risk vs reward of being here illegally will increase. We will witness a mass exodus as illegals SELF-deport, and go home on their own.</p>

			<content:encoded><![CDATA[<p><a href="http://westernfrontamerica.com/2010/04/14/haiti-quake-justify-illegal-immigration/">Haiti Quake Used To Justify Illegal Immigration</a></p><p><a href="http://westernfrontamerica.com/wp-content/uploads/2010/04/illegalhaitians1.jpg#utm_source=feed&amp;utm_medium=feed&amp;utm_campaign=feed"><img style="margin: 0px 10px 0px 0px; display: inline; border: 0px;" title="illegal-haitians" src="http://westernfrontamerica.com/wp-content/uploads/2010/04/illegalhaitians_thumb1.jpg" border="0" alt="illegal-haitians" width="168" height="128" align="left" /></a> Rush Limbaugh has been criticized for raising the issue of whether or not Haitians will be subjected to the same kinds of limitations on assistance to be imposed on Americans such as the proposed healthcare review boards popularly referred to as &#8220;death panels&#8221; because of the powers these regulatory bodies would be granted to deny life-saving treatment to those deemed of marginal socioeconomic utility by government bureaucrats.</p>
<p>Why isn’t this question raised by the broadcaster considered a valid concern?</p>
<p>If the first purpose of the United States government is to provide for the general welfare of its citizens however one might decide to define the scope of that notion, shouldn’t foreigners irrespective of the desperation of their circumstances be subject to at least the same rigors?</p>
<p>While the victims of the earthquake in Haiti deserve sympathy and charity, engaged patriots must not allow elites to use this tragedy as an excuse to blunt the discerning criticism of good citizenship.</p>
<p>Some might respond that many of the victims of this cataclysm are innocent children. And that is true enough.</p>
<p>It is one thing to allow passage for a given number of youngsters who have caretakers and provision eagerly awaiting their arrival. It is quite another to grant charity willy-nilly without question.</p>
<p>The Director of U.S. Citizenship and Immigration Services announced that up to 200,000 undocumented Haitian immigrants would be granted Temporary Protected Status upon application approval. According to the Miami Herald, temporary protected status is reserved for undocumented migrants displaced by natural disasters, armed conflicts or other emergencies; and Haitians seeking this authorization must prove they were in the United States prior to the day the quake struck.</p>
<p>In other words, the privilege to remain here is being extended to those that shouldn’t even be here in the first place. And, though they might have family on the island impacted by the quake, since those applying for this status were here in America at the time, they themselves suffered no physical injury or dislocation.</p>
<p>Since those here improperly are in violation of the law, Americans must naturally question the character of these migrants to begin with. However, it is doubtful front line immigration personnel will be given the time necessary to make the proper assessments since pressure is being applied to officials to make urgent, expedited decisions.</p>
<p>Thus, in all the administrative confusion, in all likelihood our government will end up extending the blessing of its approval to be here to a number of shady characters most upstanding Americans would not otherwise want to be around. The tolerance mongers among the readership will no doubt fly into their usual histrionics about how dare anyone say such a thing.</p>
<p>However, if these individuals are possessed of such a stellar character that they make Mother Teresa look like a Hooter’s girl, perhaps those wanting the Haitian illegals to remain here will permit the Haitians to housesit for the duration of the work permit (after the expiration of which these migrants are not going to leave anyway and anyone that claims otherwise is so bereft of commonsense that they’d take their brain out their brain and play with it if they had one). Better yet, if these new arrivals are good enough to roam freely about American streets, perhaps some should without benefit of background checks be appointed to watch the Obama children. Frankly then, if these Haitians aren&#8217;t good enough to be around the Obama&#8217;s, then we definitely don&#8217;t need them around the rest of us.</p>
<p>This attempt at immigration reform has the added caveat attached that, if you are not for it, you are opposed to assisting the adorable Haitian whelps trapped under slabs of concrete. The effort is also couched in the usual terms that everybody benefits when illegals are brought out into the open economy. But is that really so?</p>
<p>For if the Haitian illegals are made legal, won&#8217;t that require employers to pay at least minimum wage once these workers are on the books? And if that is the case, what incentive then does a business have to hire a Haitian rather than an individual of a more traditional American background or from an immigrant culture less prone to tropical proclivities of indolence and shiftlessness such as showing up at work late without much concern for temporal precision.</p>
<p>Obama&#8217;s Chief Of Staff Rahm Emanuel is credited with saying that the government should never let a good crisis go to waste. By this, the False Prophet to Obama&#8217;s Beast means that as many tragedies and misfortunes as possible should be used to accrue power to the state irrespective of whether or not the proposal under consideration is actually going to alleviate the problem in the long run. Thus, the first thing the discerning citizen should yell is “STOP” or at least “SLOW DOWN” whenever a politician of any party insists that a new program must be created or any additional money must be spent at this instance.</p>

<p>Of course this raised immediate ire amongst those who question Obama’s constitutional eligibility to serve in the office of President of the United States .</p>
<p>Before a war erupts on the Right between the Constitutional Eligibility Challengers and their deriders, BOTH sides need to step back!</p>
<p>The eligibility issue is a distraction, and as Beck RIGHTLY points out – could serve to advance Obama’s interests – at least at this point in time!</p>
<p>The focus needs to be on Obama’s policies.  ObamaCare is about to be rammed down our throats.  We must put ALL our energies into convincing our elected officials that NOTHING that comes out of Conference Committee can be acceptable and WHATEVER emerges must be voted down.  Focusing on “Where’s the Birth Certificate” right now will simply waste energy and resources that we need for the healthcare fight – and failing in that arena will permanently damage our Republic.  PRIORITIES, PEOPLE!</p>
<p>Besides, despite numerous lawsuits and millions of dollars spent on both sides, no legal authority seems willing to tackle the eligibility issue.  So many on the RIGHT dismiss it as a fringe issue that much EDUCATION is necessary before a serious challenge to Obama’s eligibility will have enough popular support as to force a real examination of the evidence.  The issue SHOULD be tabled until after the 2010 elections, when – hopefully – Obama’s ability to dismantle our Constitutional Republic will be significantly diminished.  Currently, the Obama/Reid/Pelosi Triumvirate bears enough power to do far more damage to our Constitution than the question of whether Obama meets the Constitutional qualifications for the office he was elected to and has held for a year.</p>
<p>So please, challengers to Obama’s eligibility… take a neutral corner for a while.  The bell for the round has rung.  There will be another opportunity to grapple, but right now is time for a breather, a sip of water, and some towel-fanning!</p>
<p>That said; those who dismiss the eligibility debate as unimportant, irrelevant, settled or “tinfoil hats” nutz really need to cool their jets and open their minds too.  While there are those who have made headlines and court cases postulating that Obama was born in Kenya and proclaiming the birth documents Obama has put forth as fraudulent, there are indeed others who reject that theory – yet still hold that there are OTHER constitutional disqualifiers for Obama.  To call these people “Birthers” would be inaccurate, as they don’t dispute Obama’s Hawaiian origins – as whether he were born there OR NOT, is irrelevant to their ineligibility arguments!</p>
<p>It IS a fact that the document Obama hangs his hat on, the “Certificate of Live Birth” IS NOT a “Birth Certificate”, and CAN BE LEGALLY obtained for a child not born on US Soil.  I’ve written previously on this so won’t waste space on it here.</p>
<p>It is also a fact that Obama was legally adopted by Lolo Soetoro and moved with him to Indonesia , where he was enrolled in school with documents showing him to be an INDONESIAN citizen.  Why is this important?  Because, at the time, there was NO Dual Citizenship between the US and Indonesia .</p>
<p>Then there is the Passport Question:  What passport did Obama use to travel to Pakistan ?</p>
<p>He couldn’t have travelled on a US passport, as Pakistan was a “no travel” destination for a US Passport holder.  Was he using a Brittish passport?  This would lend support to the Kenya Birth theory.  And if he travelled on an Indonesian Passport, that would prove his Indonesian Citizenship, and by extension his forfeiture of any prior-existing US Citizenship.  The answer to the question of what passport he presented on entry into Pakistan is of paramount importance to the eligibility/citizenship debate – and the “Birth Certificate” is irrelevant to that answer!</p>
<p>Therefore, my admonition to the Right is this:</p>
<p>Put the eligibility question on the shelf until after election night, 2010.  It is a potentially disastrous distraction before then.</p>
<p>But don’t forget the issue, and don’t dismiss it.  Defense of the Constitution involves defending the ENTIRE constitution, including Article II and the eligibility requirements for the person who would hold the office of President of the United States .  There is indeed reason to question Obama’s eligibility and he has invested MILLIONS in quashing the probes into the question!  Once the security and stability of the fundamental structure of the Republic can be assured (after the 2010 elections), the question MUST be raised and resolved!</p>
